By accessing or using any service, platform, or communication infrastructure provided by MgSolution, you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use our services.
These terms apply to all users of the MgSolution platform, including platform administrators, campaign operators, and any parties who interact with communications managed through our infrastructure.
Acceptable Use
MgSolution provides professional email marketing, campaign management, and business communication tools. All users of our platform agree to use these services lawfully and responsibly. Acceptable use includes:
- Sending marketing campaigns to recipients who have provided explicit consent
- Managing transactional communications related to legitimate business activity
- Using platform tools for deliverability optimization, list management, and campaign tracking
- Complying with all applicable laws, regulations, and industry standards
- Honoring opt-out and unsubscribe requests promptly and completely
Prohibited Activities
The following activities are strictly prohibited on the MgSolution platform:
- Spam: Sending unsolicited commercial email or bulk messages to recipients who have not opted in
- Fraud & deception: Using false sender information, misleading subject lines, or deceptive content
- Illegal content: Sending communications that violate any applicable law, regulation, or third-party rights
- Abuse: Attempting to circumvent platform safeguards, monitoring, or anti-abuse systems
- Harvesting: Collecting email addresses or personal data without proper consent
- Malware & phishing: Distributing malicious content, links, or attachments of any kind
- Unauthorized access: Accessing accounts, systems, or data without explicit authorization
Platform Monitoring & Enforcement
MgSolution reserves the right to monitor platform usage, review campaign activity, and take corrective action when violations of these terms are detected or suspected. This includes, but is not limited to:
- Temporarily or permanently suspending accounts or specific campaigns
- Restricting access to certain platform features or sending volumes
- Requiring additional verification before resuming service
- Cooperating with ISPs, regulators, or law enforcement authorities
- Removing or quarantining content that violates these terms
MgSolution may update, modify, or restrict platform features at any time in order to maintain service integrity, deliverability standards, and legal compliance.
User Responsibility & Compliance
Users are solely responsible for ensuring that all campaigns, contact lists, and communications managed through MgSolution comply with applicable law, including but not limited to:
- CAN-SPAM Act (United States)
- General Data Protection Regulation — GDPR (European Union)
- CASL — Canada's Anti-Spam Legislation
- Any other local or national anti-spam or data protection regulations applicable to your target recipients
MgSolution does not assume legal responsibility for content, data handling practices, or compliance obligations on behalf of individual platform users.
Limitation of Liability
MgSolution provides its platform and services on an "as-is" basis. While we strive for maximum reliability and deliverability, we do not guarantee uninterrupted service availability, specific delivery rates, or open/click performance outcomes.
MgSolution shall not be held liable for indirect, incidental, or consequential damages arising from platform use, service interruptions, or third-party actions including but not limited to ISP blocking, spam filtering, or deliverability fluctuations.
Changes to These Terms
MgSolution may revise these Terms of Use at any time. Continued use of the platform after any update constitutes acceptance of the revised terms. We encourage users to review this page periodically.
